Terms of Service
Last updated: [date]
These Terms of Service ("Terms") govern access to and use of SkillScorer (the "Service"), provided by [legal entity name / Peter's name or ABN, once decided]. By creating an account or using the Service, you agree to these Terms.
1. The Service
SkillScorer is a skills assessment and tracking platform available via web browser, installed Progressive Web App, and native iOS/Android apps. It allows organisations to record, assess, and report on skills across individuals within the organisation.
2. Accounts & organisations
- An organisation is created by a registering administrator, who is responsible for the accuracy of the organisation's data and for managing user access within that organisation.
- Organisation administrators are responsible for ensuring they have the right to enter and store data about assessed individuals within their organisation (see Privacy Policy, Section 8, for minors).
- You must provide accurate registration information and keep your login credentials secure. You are responsible for activity under your account.
- Roles and permissions within an organisation (Admin, Manager/Coach-equivalent, and other role types) are controlled by the organisation itself.
3. Acceptable use
You agree not to:
- Use the Service to store or process data you do not have the right to store (e.g. assessing individuals without appropriate authority or, where required, consent)
- Attempt to access another organisation's data without authorisation
- Reverse engineer, scrape, or attempt to extract the Service's source code or underlying data structures beyond normal use of exported reports
- Use the Service to violate any applicable law
- Interfere with or disrupt the integrity or performance of the Service
4. Data ownership
- Your organisation retains ownership of the data it enters into SkillScorer (skills, scores, assessed individual records, etc.).
- We do not claim ownership over your organisation's data and will not use it for purposes outside operating and improving the Service, as described in the Privacy Policy.
- On request, your organisation may export its data or request account closure. [Confirm export format/process once built — e.g. CSV export via reports, or a full data export tool.]
5. Availability & changes to the Service
- We aim to keep the Service available but do not guarantee uninterrupted access. Planned maintenance or unforeseen issues may cause downtime.
- Features may be added, changed, or removed over time as the product evolves. [If pre-launch/beta, add a line noting the Service is under active development and features may change without notice during this period.]
6. Fees & billing
Pricing and billing terms will be published at /pricing once finalised. [This section to be completed alongside the pricing decision — should cover: billing cycle, trial terms, cancellation, refund policy, and what happens to data on non-payment/cancellation.]
7. Termination
- You may stop using the Service and close your organisation's account at any time by contacting us.
- We may suspend or terminate accounts that violate these Terms, including the Acceptable Use section above.
- On termination, we will [retain data for X days for potential reactivation, then delete / delete immediately / provide an export window — confirm policy, should match Privacy Policy Section 6].
8. Disclaimers & limitation of liability
- The Service is provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by law.
- SkillScorer is a tool to support assessment and record-keeping; decisions made based on its reports (e.g. selection, promotion, competency sign-off, compliance decisions) remain the responsibility of the organisation and its users.
- To the maximum extent permitted by law, SkillScorer's liability for any claim arising from use of the Service is limited to the amount paid for the Service in the [12 months] preceding the claim. [This clause needs legal review — enforceability varies by jurisdiction, and Australian Consumer Law guarantees may not be excludable for consumer transactions.]
9. Industry-specific compliance
Where SkillScorer is used in regulated contexts (e.g. Healthcare competency records, Emergency Services readiness tracking, Education), the organisation using the Service remains responsible for meeting any industry-specific regulatory, licensing, or record-keeping requirements that apply to it. SkillScorer is a record-keeping and assessment tool, not a substitute for professional or regulatory compliance advice.
10. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. Material changes will be indicated by updating the "Last updated" date above.
11. Governing law
These Terms are governed by the laws of [state/territory], Australia. [Confirm jurisdiction once business structure is finalised.]
